Vous, personne physique candidate à l’assurance ou personne morale pour le compte de vos employés, adhérant librement à la convention négociée et souscrite par APS-Bénin ("le Souscripteur") pour le compte de ses Adhérents, dont les coordonnées sont celles déposées sur les formulaires du Site ou les documents d’adhésion. L'adhérent signe la demande d'adhésion et est redevable de la cotisation d'assurance et des droits d'adhésion à l'APS. Il peut être différent du Bénéficiaire qui est l’assuré bénéficiaire des garanties. Pour souscrire au contrat SƆHU, l'Adhérent doit être membre de l'APS-BENIN moyennant une cotisation annuelle indiquée sur les documents d'adhésion et accepter sans contestation aucune les statuts et le règlement intérieur de l’Association, téléchargeables sur le Site ou disponibles sur simple demande à l'APS-Bénin. Il reconnaît également avoir pris connaissance des conditions générales de la police (téléchargeables sur le Site ou sur simple demande auprès de l'Assureur). Il est important que Vous comme les Bénéficiaires aient bien compris le fonctionnement du contrat, les délais de carence, les exclusions etc avant de vous engager. L'Assuré principal reste seul responsable de ses déclarations à l'Assureur (questionnaire médical) pour lui-même comme pour ses Bénéficiaires.

Nous, Africa BSI, courtier en assurances à Cotonou régulièrement enregistré, Mandataire de l’association APS-BENIN, chargé de la souscription de l'assurance SƆHU pour le compte de ses adhérents avec délégation d' Atlantique Assurances Bénin, l'Assureur.

Procédure de souscription médicale
Nous proposons une procédure de vente et de souscription visant à une sélection des risques pour assurer l’équilibre de la convention négociée par l'APS pour ses Adhérents. Toutes les adhésions sont conditionnées par une « souscription médicale » des Bénéficiaires : questionnaire médical + visa médecin conseil de l’APS-BENIN. Il est communiqué sur le Site et les documents commerciaux une grille tarifaire pour les cas « standards ». Les dossiers considérés « non standards » et ceux des candidats à l’assurance âgés de plus de cinquante ans sont soumis à l’appréciation des médecins conseil de APS-BENIN et de l'Assureur. Le médecin conseil de l'Assureur est seul habilité à trancher en dernier ressort. Ses décisions sont souveraines et ne peuvent être contestées par un candidat à l’assurance ni par l'APS-Bénin.

La déclaration de l'Adhérent et des Bénéficiaires
Conformément au Code CIMA, l'Adhérent et le Bénéficiaire déclarent que l'ensemble des informations qu'il fournit à l'Assureur est exact. Ces informations servent de base aux Conditions Particulières. En cas de changement de sa situation telle que déclarée au jour de la signature du Contrat, l'Adhérent s'engage à mettre à jour les informations le concernant, via courrier adressé à l'Assureur ou son représentant contre accusé de réception.

La fausse déclaration intentionnelle est sanctionnée par la nullité du contrat. Les primes payées demeurent acquises à l’Assureur (Article 18 du code CIMA).

La procédure de souscription du Contrat
Après avoir consulté librement la description des garanties et les Conditions Générales du Contrat, le candidat à l’assurance peut effectuer sur le Site des simulations tarifaires, demander un devis ou compléter en ligne le formulaire de demande d’adhésion à l'APS et au contrat SƆHU. Il renseigne alors les informations concernant son identité, indique ses choix de garanties, les Bénéficiaires des garanties et répond à toutes les questions. Chaque Bénéficiaire majeur complète un questionnaire médical. Pour les mineurs, c’est le représentant légal qui est responsable des déclarations. L'Adhérent et les Bénéficiaires acceptent les dispositions contractuelles (Conditions générales et documents contractuels) en cochant la case réservée à cet effet. Les formulaires peuvent être également téléchargés ou sont à disposition auprès des Intermédiaires agréés par Atlantique Assurances Bénin.

Conformément au code CIMA, la demande d’adhésion n’engage ni le candidat à l'assurance, ni l’Assureur. A réception de la demande d’adhésion en ligne ou physique, le Mandataire procède à l’analyse du dossier médical, avec visa du médecin conseil de l’APS-BENIN en charge de la pré-souscription.

Si le profil médical le justifie (pathologie préexistante ou chronique, candidats à l’assurance âgés de plus de cinquante ans…), la souscription peut être conditionnée par une visite médicale du Bénéficiaire auprès du médecin conseil de l’APS-BENIN. Si le Bénéficiaire réalise l’examen, la consultation est payable directement par lui au cabinet médical (10 000 F CFA). En cas de souscription à SƆHU par un Bénéficiaire ayant eu à supporter le coût d’une visite médicale, APS-BENIN rembourse, sous un mois, 50% du coût de la consultation (soit 5 000 F CFA), par chèque ou Mobile Money, au Bénéficiaire.

Le médecin conseil de l’APS-BENIN communique un avis confidentiel au médecin conseil de Atlantique Assurances Bénin, seul décideur de la décision de souscription et de la tarification pour ces cas-là. APS le Souscripteur du contrat n'a en aucun cas à justifier aux adhérents des décisions de l'Assureur qui sont souveraines.

Une fois la décision de l'Assureur communiquée au Mandataire, celui-ci envoie au candidat à l'assurance un mail, ainsi qu'à l'Intermédiaire en charge, avec un appel de cotisation et l’ensemble des documents précontractuels ainsi que sa facture d'adhésion à l'APS si elle est due.

Si le candidat à l'assurance accepte les conditions proposées par la Compagnie d’Assurances, il peut procéder au paiement intégral de la prime et (si elle est due) au paiement de son adhésion à l'APS par chèque libellé à Atlantique Assurances, en espèces ou par virement sur les comptes de Atlantique Assurances. Une fois les fonds reçus par l'assureur (dans un délai maximum de 90 jours après la demande d'adhésion), le Contrat est conclu et les garanties activées. L’adhésion est matérialisée par un certificat d’assurance électronique envoyé sous 24h à l'Adhérent par mail puis une notification d’expédition des documents contractuels, de sa carte personnalisée lui donnant accès au réseau tiers-payant de l'Assureur et de son adhésion à l'APS (le "Welcome pack SƆHU"), via l'intermédiaire en charge.

Les documents sont par ailleurs accessibles à l'Adhérent dans son « espace assuré » sur le Site. APS-BENIN enverra par mail à l'Adhérent ses identifiants pour se connecter.

Le délai de livraison du "Welcome pack SƆHU" est de un mois maximum à compter de la date de réception des fonds par la Compagnie d’Assurances. En attendant la réception de son "Welcome pack SƆHU", le bénéficiaire est cependant couvert suivant les termes du contrat et son certificat électronique d'assurance pourra être présenté dans le réseau tiers-payant de l'Assureur.

Conditions de rétractation
Le client dispose d’un délai de 7 jours à compter de la date de son paiement pour exercer son droit de rétractation par courrier recommandé à Atlantique Assurances Bénin ou à l’intermédiaire en charge. La prime lui sera alors remboursée à 90% par la Compagnie d’Assurances dans la mesure où le contrat n'a pas été utilisé. Les droits d’adhésion à l’Association sont acquis à l’Association dont il reste membre tant qu'il réglera ses cotisations annuelles.

Perte de la carte d’assuré
En cas de perte de la carte d’assuré, il sera demandé par l'Assureur à l’Adhérent un forfait de 5 000 F CFA pour sa réédition.

Réclamations
Les réclamations sont reçues avec bienveillance attentive. En cas de litige, le client peut s'adresser au Président de l'APS-Bénin, souscripteur du contrat collectif, de préférence par mail à : contact@aps-benin.com pour obtenir, si possible, une solution amiable. Il peut aussi contacter Atlantique Assurances Bénin à l’adresse indiquée sur le site de Atlantique Assurances Bénin.

Protection des données personnelles
Les informations recueillies sur le Site font l’objet d’un traitement destiné à la souscription et à la consultation des contrats d’assurance et l’exécution de l’ensemble des services qui y sont rattachés.
